In my mind that is a completely different situation. U r talking about a man made imperfection that affects a specific card or deck of cards. That 100% is a problem. Ivy didn’t have a specific deck(s) marked and he certainly didn’t request that the casino use a specific deck with a known man made imperfection that is different than other decks made by the same manufacturer. That clearly would have been cheating. He simply requested a specific card manufacturer, a manufacturer that was used by many casinos. There is nothing wrong with that in my mind.

Along those lines - is card counting illegal? Nope. Casinos just don’t like it cause it takes away their edge. What about if ur at a poker game and u notice a player’s tell. Based on that tell u now know exactly what that player is holding. Do u have an obligation to tell that player and/or the other players? We all know the answer to that.

Is card counting illegal? I think that the answer is neither Yes or No, but depends on the specific jurisdiction.
