If stole merchandise is sold. The buyer of stolen merchandise will still have it confiscated by authorities. It does not mean you committed a crime but it does still mean a crime was committed. If police were to investigate this, they would confiscate the chips and return them to their rightful owner. You would be out whatever you paid for stolen merchandise.

If this is true that is pretty terrifying. What if you bought a car on Craigslist and it turns out to be stolen? You lose thousands of dollars and don't get compensated even though you did nothing wrong?
 
This is from a PM from davin to me on Aug 4:

well this is officially the last rack of 1's that i have left in my possession there has been a box stuck in customs since feb, yes feb ridiculous that my supplier is still trying to get released, they have not given reasoning but we think its how he worded the description. in the description contents he listed it as GIFT POKER CHIP. this was the first box sent that never made it thru.

This is kinda my concern. I know I'm only in $50 of my actual cash monies, but the idea that I'm on the hook for "stolen" goods doesn't sit well with me.
 
@davin did you buy these for yourself or to resell? Is there a deal you could work out with him if he's willing to pay you for some or all of the chips at cost? Just trying to find a solution that helps everyone.

Yes. Sucks. You would have to go through the trouble of suing the person who sold it to you. This is why doing a VIN search is important as it will tell you if the car is salvaged or stolen etc

Pawn shops always take this same risk when they pawn or purchase something. If it’s stolen, it’s confiscated and they are just out the money.

chips were had a 100 value on them as they came from INT. no one has been reimbursed, they couldn't even say if it was loss in customs held up in customs nothing

I understand they were paid for in full and went missing in the mail after payment.
 
You say that you are sick over this whole issue. The smoking gun was posted, so I would say you should honor you aforementioned commitment to do the right thing and ship the chips. It's just 50 bucks and a lost dream.

You aren't on the hook as in jail time or at fault bro. You should just do the right thing and help a fellow member. I hope it works out and you stick around.

So the seller kept your money even though you never received them?
till this day we have been trying to have the box located..... I've sent multiple search requests and have the receipts to show
 
I've lost boxes in the mail before. If months later, someone found the same chips I wouldnt ask for them back. Even if I was 100 percent sure that they were the chips I lost. I would say congrats on the find man. If I really wanted the chips I would offer to buy them. @luv2breformed didnt do anything wrong. He searched and found a great deal on some chips. I dont think he is in any way obligated to send the chips to @davin The fact that they have green sharpie on the boxes doesnt mean much. Who is the mysterious seller with the crappy hand writing? The fact that an eBay seller sold them for 50 dollars doesnt mean much either. I have got some great deals on eBay. They are few and far between, but they are out there if you search hard.

Here is another scenario. What if a casino worker or someone related to the auction got these and gave them away as a gift? What if the person that received the gift didnt want them, and didnt know their value, and sold them on eBay for 50 dollars? Is that not possible?

I also think that when you send something in the mail and dont insure it it is your own fault. I mean, I dont always insure my packages, but I know it is a gamble and I am alright with taking the risk. If a package of mine goes missing I would never ask for someone to repay me for a loss I took.

If I got this deal on eBay or any other classifieds listing I wouldnt send them to someone else for free. I would however tell @davin who I bought them from. There is no way that anything would come of it though. There is simply no evidence that this eBay seller stole these chips. Try going to the local police with the green sharpie theory. See how far that will get you.

If i hadn't seen the photos of the green sharpie on the box i would have gone on with my day, but once i knew it had the distinct green sharpie on it i was for sure certain these were the missing chips

look at the two photos there's no way you can remake the distinct 5 written in the photos from Feb when they went missing

The car was a terrible example. I just didn't know they confiscate it without repayment, I assume most of the time the thief is caught before the end buyer is forced to give up anything. Then hopefully the thief is on the hook for giving the money back or something. Makes sense to return to the rightful owner of course, but an innocent 3rd party shouldn't get screwed in the process because of some thieving douche.

I'd be the same way... If I got some of them back, I'd be thrilled. But I would have accepted them being gone long ago. Anything more then nothing would be gravy.

Because if he was compensated then who even paid him is the owner (I think).

This is still unclear to me. After reading the op it seams davin said his seller was out 1k? Who is at a loss right now @davin
 
Wow, that's a horrible situation. I'm sorry you both have to deal with this. I can imagine this is a shitty position for a new chipper to be in.

My opinion - Let's be real, those are stolen property. Anyone with drug addicts or criminals in the family knows about crackhead prices. Of course the seller didn't know the value and someone got a chip hunter/picker bargain basement deal.

However, chip karma, ethics, and deductive logic would tell us pretty clearly that these were intended to be @davin's chips. I'm not a lawyer and won't speak to the legality of this, but if it were me, I'd ask @davin for the $50 + shipping and send him the chips. From there, I would enjoy infinite chip karma, a lifelong friend, and great standing within the chip community. At the end of the day, the weirdos on the site are all we have to share in this strange hobby.
 
@davin Where you the receiver of said missing box? Which country's Customs was it stuck in?
